your new husband would have to adopt him legally as his son (i think)I am getting married soon can i change my sons name 2?
Talk to an attorney. You really don't just change his name, he will most likely have to be adopted by your new husband.
Birth father has to give his permission, otherwise it won't be legal.
the only way you can change your son's last name is to take all legal rights away from the real father then your new husband can adopt him
You usually need a death certificate of the mother, the mother's permission or a court judge to give you permission to do it.

Most likely they won't do it since the mother is still alive (apparently) and you would need her permission to do it.
YES THE ONLY THING IS THAT IT IS TREATED AS A ADOPTION AND THE BIRTH FATHER HAS TO SIGN OVER HIS RIGHTS I WENT THROUGH THE SAME THING SO YOU MAY WANT TO GET A HOLD OF THE BIRTH FATHER SO HE WILL SIGN OVER HIS RIGHTS
You should consult a lawyer before filing for a name change due to laws and the other parent's rights
your new husband would have to adopt the child... check with your local clerk of courts when you file for your marriage licence...
You need to talk to a lawyer who can file the paperwork and get a judge to grant the name change.
You can only change it if he adopts your son. Which would be a good idea if God forbid something happened to you, then he would be able to stay with his new step-dad to be.
Yes, you legally change a minors name. You can get the legal forms, and filing instructions at - http://www.legalformsbank.biz/namechange鈥?/a> - and you can learn more about the procedure there.
You can go to court and have it changed.
first if your son is under his biological father's name, he has to sign some documents that he agrees to change or to give your child for adoption which is under your future husband. all the docuuments needed has to be authenticated by a lawyer, i believe you have to go to your national statistics office for processing.
my brothers wife had a kid with smeone else and she wanted all her kids to have the same last name and wanted to change the kids to my brothers,, anyway, to do that my brother would have had to adopt him and im not sure but the birth father may have to sign his right over to do that, but then u wont be eligable for child support from the birth father, just the ADOPTED father,, which is why my brother didnt do it (they were shakey) and good thing he didnt, they broke up again and he would have had to pay for a kid that isnt his while the birth dad would have been off the hook!

at any rate
I don't think ur son would appreciate that once he gets older
You can have his name changed legally like any other name.
Your son is not getting married. In order for the boy to have his step fathers name legally, the man must adopt him. Pax Christi
