If you file for bankruptcy, and you have joint accounts, it's both of you.





Your earnings will be garnished, which include military and state stipends.Can you file for bankruptcy alone even if you're married?
You CAN file individually. If you do, your spouse is STILL liable for the FULL amount of any joint debts. Social Security and some pensions are not subject to DIRECT garnishment. That said, any account they are deposited into IS subject to garnishment unless you can prove the ONLY source of funds in the account is non-garnishable.
