Can you get married in Florida and get a green card even if your passport and visa are expired but present?

What States offers ways to become a legal alien in the U.S. and what other existing and real ways if any? The question reflects a situation where the passport and the C1/D visa have expired. As long as has entered legally , the marriage is real (not a fraud) and he/she has not criminal charges, there are no problem.


The steps for become a legal alien and then a permanent resident are the same no matter what State, because you have to apply to the USCIS (Federal).


You can get married in any states and then (let pass 2 months)file the petition for change of status.


You can go to www.uscis.gov look where say ';how ti become a permanent resident'; ( Green Card)


There you will find the forms e intructions. Go for the I-485 read the instruccions ans you will realize you need present several together I-765, I-130,I-864 etc and pay like $1365 in fees.


Once you filled that you will have the EAD in 3 months and the green card after a year aprox.

If your fiance is here in USA, and her/his visa is expired, you can still married with her/him, after you married you apply for her/him papers. She/he can wait the visa/GC with you here in USA without problems.


But do not wait long time, because the if the Immigration find him/her without a valid visa, can be deported.
If your fiance is a USC and you have proof of your legal entry (I-94) then you can adjust your status in-country and obtain your GC.
C1/D visa holders cannot adjust their status in US.
