I owe back taxes as a single person. I got married & will file as married for 2008. What will happen?

I have 3 years placed on CNC status dating back to 2001. That was when I was a single parent. Now that I am married, will they reopen the case? I plan to file as ';married filing separately';. Will that make a difference? Do you think they will go after my husband for what I owe? If so, how easy is it to file ';innocent spouse';? Thanks in advance!I owe back taxes as a single person. If you file MFS then your spouse's refund cannot be touched. However you will pay higher taxes in most cases that way. A better option would be to file a joint return with your spouse and your spouse attach Form 8379 to claim Injured Spouse status to protect his share of any resultant refund. (This is different from Innocent Spouse, a totally different concept that does not apply here.)





The IRS may well restart collection actions against you now. Anything that changes your financial situation can impact deferred collection status and getting married certainly can change that.I owe back taxes as a single person. I got married %26amp; will file as married for 2008. What will happen?

They will take more out of your wifes taxes.


Then you both will have to file for 'injured spouse'


Talk to your agent, they could tell you more.
